The MOVESMART Programme

Welcome to the MOVESMART Programme (“MOVESMART”, “we”, “our”, “us”). These Terms and Conditions (“Terms”) govern your participation in our classes, courses, online content, and all related services (“Services”). By accessing or using any MOVESMART Services, you agree to these Terms. If you do not agree, please discontinue use of the Services.


1. Eligibility

  • You must be at least 18 years old to participate in the MOVESMART Programme or to use our online Services.
  • This applies to both MOVESMART: MOVEIT and MOVESMART: MINDSET

2. Health & Safety

  • You are fully responsible for your own health, safety, and wellbeing during all MOVESMART sessions—whether in person or online.
  • It is strongly recommended that you consult your doctor, physiotherapist, or a qualified healthcare professional before beginning any new exercise or falls-prevention programme.
  • You must accurately complete the PAR-Q assessment form and sign it before you take part in any class.
  • You must inform the instructor of any injuries, medical conditions, limitations, or recent surgeries that may affect your ability to participate safely.
  • Stop exercising immediately if you experience pain, dizziness, shortness of breath, or discomfort.
  • You agree to ensure that your environment (including at-home practice) is safe, clear of hazards, and appropriate for exercise.

3. Health Disclaimer (Not Medical Advice)

  • The MOVESMART programme provides general exercise, balance, and falls-prevention guidance. It does not provide medical or clinical advice.
  • No content—videos, assessments, handouts, written guidance, or instructor explanations—should be interpreted as a diagnosis, treatment plan, or substitute for professional medical advice.

4. Personal Responsibility & Assumption of Risk

By participating in MOVESMART, you acknowledge and agree that:

  • Physical exercise carries inherent risks, including injury or falls.
  • Participation is entirely voluntary.
  • You assume full responsibility for your own participation, choices, and physical limits.
  • You will only perform movements and exercises within your personal capability.

5. Liability

To the fullest extent permitted by law:

  • MOVESMART, its facilitators, employees, and partners are not liable for any personal injury, accident, health issue, property damage, or loss of personal belongings that may occur during or after participation in the Services.
  • You participate at your own risk.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.


6. Conduct & Class Etiquette

All participants must:

  • Act respectfully toward facilitators and fellow participants.
  • Follow instructor directions to maintain a safe and supportive learning environment.
  • Keep mobile phones silenced and put away during sessions unless required for emergency contact.
  • Refrain from disruptive, unsafe, or inappropriate behaviour.

MOVESMART reserves the right to refuse participation or remove a participant for breaching these standards.


7. Booking, Payments & Attendance

7.1 Booking & Payment

  • MOVESMART: MOVEIT – Classes, courses, and in-person sessions generally require advance booking. Payment is on a rolling basis, pay as you go.
  • Payment confirms your place and acceptance of these Terms.
  • MOVESMART: MINDSET – is either a block of 10 sessions or 4 workshops. Unless otherwise stated these sessions must be paid for in advance.
  • Corporate, organisational clients, Local Authorities, Private Hospitals, The NHS and insurance companies are covered through separate arrangements.

7.2 Refunds

  • Payments are non-refundable and non-transferable, except where required by law or at MOVESMART’s discretion in exceptional circumstances.
  • Prepaid passes or memberships may have fixed validity periods.

7.3 Cancellations

  • You are expected to cancel any booking you cannot attend.
  • Late cancellations or no-shows may result in:
    • Loss of the class credit/pass, or
    • A late cancellation fee, depending on programme rules.
  • Cancellation windows will be communicated at booking.

8. Online Access, Accounts & Subscriptions

If you purchase digital content, online courses, or membership access:

  • Payments must be made in full at checkout.
  • Access remains available only for the period stated at purchase.
  • Sharing login details, downloadable materials, or paid content with others is strictly prohibited.
  • Fees are generally non-refundable, unless required by law.

9. Intellectual Property

All ‘THE MOVESMART PROGRMME’ materials—including but not limited to:

  • videos
  • text, guides, and worksheets
  • exercise routines
  • logos, branding, and images
  • website content
  • course materials
  • layout, design, and structure
  • the MOVESMART: MINDSET content, structure and approach

are protected by copyright and intellectual property laws.

You may not:

  • copy, reproduce, distribute, modify, republish, or share The MOVESMART programme content without explicit written permission
  • use the MOVESMART programme  name, logo, or materials for commercial or training purposes
  • share materials with third parties

You may download materials solely for your personal use.


10. Third-Party Links

Our Services may include links to external websites or resources. The MOVESMART programme does not endorse, control, or take responsibility for the content, practices, or policies of these third parties.


11. Indemnification

You agree to indemnify and hold MOVESMART harmless from any claims, losses, damages, or expenses arising from:

  • your participation in The MOVESMART Programme activities
  • your misuse of the Services
  • your breach of these Terms
  • any negligence on your part

12. Privacy

Your privacy is important to us. Our Privacy Policy explains:

  • what data we collect
  • how it is used, stored, and protected
  • your rights regarding your personal information
